Whereas:a. International cooperation in halal product assurance is necessary to improve and develop the implementation of halal product assurance;

- Foreign Halal Certification Bodies(FHCBs)may be established by:
- Government; or
- Local Islamic religious institutions.
- TheFHC B referred to in paragraph(1)must be independent, competent and free of conflicts of interest.
- Mutual recognition and acceptance of FHCB is established by certification and/or conformity assessment ofFHCBthroughassessment, inspection and signing of Mutual Recognition Agreements(MRAs)forFHCB.
Article II
For the purpose of accreditation and/or conformity assessment of foreign Halal Certification Bodies (FHCBs) in accordance with Article1(3), accreditation guidelines are hereby established. The conformity assessment guidelines for foreign halal certification bodies(FHCBs)are annexed to the regulations of the bodyand are an integral part thereof.
Article III
These Regulations shall enter into force on the date of their entry into force.

International cooperation in halal product assurance is essential for improving and developing the implementation of halal product assurance, promoting mutual recognition and acceptance of halal certificates,

To determine mutual recognition and acceptance of halal certificates, compliance of foreign halal certification bodies (FHCBs) is assessed through certification, inspection and signing of mutual recognition agreements (MRAs) with government-owned halal certification bodies(FHCBs) andhalal certification bodies belonging to local Islamic religious institutions.
FHCB certification obtained from local government Certificates issued bycertification bodies are issued by the certification body:
- Has cooperated in the development of programmes for mutual recognition and acceptance of conformity assessment results and has been endorsed by regional or international accreditation cooperation organizations; and
- Conformity assessments have been conducted in the form of Halal Standard assessments in accordance with Halal Product Assurance Standards.

- For the scope of competencies in the Food and Beverage Group and food and beverage related services, halal auditors must have at least abachelor's degree infood, food technology, chemistry, biochemistry, biology, culinary arts, agriculture, agricultural technology, nutrition, animal husbandry, forestry or fisheries;

Application for accreditation and/or conformity assessment of foreign halal certification bodies
- The process of applying forFHCBcertification is carried out by/for the following reasons:a. Foreign holding companies that do not have any regional or international standing in the country in which they are located
accredited certification body; or
b. IsFHCB willing to apply directly to Halal Certification Body for certification
Product Assurance Organization (BPJPH).
- Asdescribed in point 1, theLPHcertification team performs certification by assessing compliance withISO/IEC17065and Indonesian halal standards.
- FHCB conformity assessment isa certificate of accreditation issued by a member accreditation body ofthe International Accreditation Forum Multilateral Accreditation Arrangement (IAF MLA), the IslamicInstitute of Standards and Metrology(SMIIC) and/or the International Halal Accreditation Forum(IHAF) in accordance with ISO/IEC 17065 for accredited halal certification bodies.
- Asmentioned in point 3, conformity assessmentiscarried out by the FHCB assessment team appointed by the BPJPH Headto assess whether the product meets theIndonesian Halal Product Assurance Standards in terms of technology and Islamic sharia.

- If the FHCBfails to address the comments of the assessment panel within 15 (fifteen) working days, the application for certification and/or conformity assessment will be rejected.
- If the application for certificationand/or conformity assessment is rejected,FHCBmay reapply at the earliest 6 months after the rejection of the application.
- If the FHCBapplies for certificationand the conformity assessment is approved by the assessment panel, discussions between theFHCBand the certification panel will be arranged.
- Discussions with the certification team will take place within10 (ten)business days of the document being deemed compliant.
- If the certification panel approves the certification without any objection, the Executive Committee will issue a letter of recommendation as the basis for issuing the certification.
- If the certification team has any comments,FHC B must address them within15 (fifteen)working days.
- If the FHCBfails to process the comments of the certification team within 15 (fifteen) working days, the certification and/or conformity assessment application will be rejected.
- If an application for certificationand/or conformity assessment is rejected,FHC B may reapply at the earliest six months after the rejection of the application.
- If BPJPHfinds evidence of fraud, deception, falsification or deliberate concealment of information by FHCB when submitting an application or during the certification and/or conformity assessment process,BPJPHwill reject the application, stop or cancel the certificationand/or conformity assessment processandFHCBwill not be allowed to reapply.

- BPJPHThe Head appoints and assigns assessment team leaders, secretariats, technical assessors and sharia assessorsto check the validity of documents and/or conduct field assessments.
