NUMBER 748 OF 2021

ON

TYPES OF MANDATORY HALAL-CERTIFIED PRODUCTS

BY THE BLESSINGS OF THE ALMIGHTY GOD

MINISTER OF RELIGIOUS AFFAIRS OF THE

REPUBLIC OF INDONESIA

Considering : a. that in order to provide guidance and legal certainty

regarding types of mandatory halal-certified

products as well as to manifest an orderly

administration while organizing halal product

assurance;

b. that the Ministerial Decree Number 464 of 2020 on

Types of Mandatory Halal-Certified Products no

longer complies with the legal development resulting

in the need for replacement;

c.

that in accordance with the consideration as

intended in points a and b, as well as to implement

the provision in Article 138 paragraph (2) of the

Government Regulation Number 39 of 2021 on the

Implementation of Halal Product Assurance Sector

and Article 29 paragraph (2) of Ministerial Decree of

Religious Affairs Number 26 of 2019 on the

Implementation of Halal Product Assurance, a

Ministerial Decree of Religious Affairs on Types of

Mandatory Halal-Certified Products

shall be

specified;

Observing : 1. Law Number 33 of 2014 on Halal Product Assurance

(State Gazette of the Republic of Indonesia of 2014

Number 295, Supplement to the State Gazette of the

Republic of Indonesia Number 5604);

2. Law Number 11 of 2020 on Job Creation (State

Gazette of the Republic of Indonesia of 2020 Number

245, Supplement to the State Gazette of the Republic

of Indonesia Number 6573);

3. Government Regulation Number 39 of 2021 on the

Implementation of Halal Product Assurance Sector

(State Gazette of the Republic of Indonesia of 2021

number 49, Supplement to the State Gazette of the

Republic of Indonesia Number 6651);

4. Regulation of the President of the Republic of Indonesia

Number 83 of 2015 on Ministry of Religious Affairs

(State Gazette of the Republic of Indonesia of 2015

5. Ministerial Decree of Religious Affairs Number 42 of

2016 on Organization and Work Procedure of the

Ministry of Religious Affairs (State Gazette of the

Republic of Indonesia of 2016 Number 1495);

6. Ministerial Decree of Religious Affairs Number 26 of

2019 on the Implementation of Halal Product

Assurance (State Gazette of the Republic of Indonesia

of 2019 Number 1191);

HAS DECIDED:

To enact : MINISTERIAL DECREE OF RELIGIOUS AFFAIRS ON THE

TYPES OF MANDATORY HALAL-CERTIFIED PRODUCTS

FIRST : To specify the Types of Mandatory Halal-Certified

Products as stated in the Annex which serves as an

inseparable part of this Ministerial Decree.

SECOND

: The types of products, as mentioned in the FIRST Dictum,

are classified according to their own special features,

taking into account the composition of the constituent

ingredients and/or the production process, which include:

a. food;

b. beverages;

c.

medicines;

d. cosmetics;

e. chemical products;

f.

biological products;

g. genetically modified products;

h. goods;

i.

slaughtering services;

j.

processing services;

k. storage services;

l.

packaging services;

m. distribution services;

n. trading services; and

o. presentation services.

THIRD

: The special features as intended in SECOND Dictum serve

as guidance to:

a. The Head of Halal Product Assurance Organizing

Agency, in:- 4 -

1. specifying the types of products whose halal

certificate application shall be submitted by

business doers;

2. calculating and specifying halal certification fee

to be paid by business doers; and

3. issuing halal certificates.

b. Fatwa Commission of Indonesian Ulema Council in:

1. specifying the type of product that will be

granted the issuance of halal decision;

2. specifying the number of halal decisions that

will be issued per the quantity of the products

listed by the business doers.

c.

Halal Inspection Bodies, in:

1. discovering the types of products and its details

proposed by business doers for an inspection

and/or assessment; and

2. calculate the inspection and/or assessment fees

of the products and goods proposed for a halal

certification.

d. Ministries/Institutions, in:

1. discovering the types of products whose halal

certificate proposal shall be submitted by

business doers; and

2. implementing halal certification facilitating

programs for the entrepreneurs of micro and

small enterprises.

e. Business Doers and Public, in:

1. discovering the details regarding the types of

products that are required to be halal-certified;

2. specifying the number of application forms that

shall align with the number of the registered

products; and

3. calculating the amount of halal certification fee

according to the number of products that will be

registered for halal certification.

FOURTH : As for types of products that have not been listed in the

Annex of this Decree, or have been changed in obedience

to the laws and regulations, business doers may propose

for halal certificate and the Head of Halal Product

Assurance Organizing Agency will subsequently classify

such products after coordination with the relevant

ministries/institutions and Indonesian Ulema Council. - 5 -

FIFTH

: The Head of Halal Product Assurance Organizing Agency

shall state the types of products, as intended in Dictum

FOURTH in the List of Type of Mandatory Halal-Certified

Products, on the media that may be comfortably and

widely accessed by business doers, halal inspection

bodies, and public.

SIXTH

: The List of Types of Mandatory Halal-Certified Products as

intended in Dictum FIFTH is specified to be a legitimate

and legally binding document.

SEVENTH : At the time when this Ministerial Decree comes into force,

the Ministerial Decree Number 464 of 2020 on the Types

of Mandatory Halal-Certified Products shall be repealed

and declared ineffective.

EIGHTH :

This ministerial Decree come into force on January 2022.
