New Deadline for Halal Certification of Enterprises

The Indonesian government has issued Government Regulation (GR) No. 42/2024, which sets a new deadline for halal certification of food and beverage (F&B) products, raw materials, and slaughter related services, regardless of the size of the enterprise. The deadline is as follows:

What is the validity period of Halal certification? How to update?

For companies conducting business in Indonesia or targeting the Indonesian market, halal certification is crucial. According to the latest update of GR No. 42/2024, significant changes have been made to the effectiveness and renewal process of the Halal certification program.

According to the previous regulation No. 39/2021

The Indonesian government stipulates that halal certificates issued by the Indonesian Halal Product Assurance Organization (BPJPH) are valid for 4 years. Enterprises must apply for renewal at least 3 months before the certificate expires.

According to the new regulation No. 42/2024

If the material composition and halal production process of the product remain unchanged (PPH), the halal certificate issued by BPJPH now has an indefinite validity period.

Renewal requirements under GR No. 42/2024

Renewal is only required when you make modifications. For example, assuming any changes occur in material composition, PPH, or product development. In this case, the enterprise must submit a new application to BPJPH and provide the necessary supporting documents to update its Halal certificate.

How to obtain Halal certification for foreign products in Indonesia

Halal certification ensures that products comply with Islamic law standards, especially in Indonesia where Halal certification is a mandatory requirement for most food and beverage (F&B) products.

Foreign companies interested in entering the Indonesian market must understand the halal certification process, including recognizing foreign halal certifications.

Requirements for food and beverage products

All food and beverage products sold and distributed in Indonesia, except those made from ingredients prohibited by Islamic law (haram), must obtain Halal certification from the Halal Product Assurance Management Agency (BPJPH).

Scope of Certification

The scope of certification includes raw materials, food additives, auxiliary materials used in production, slaughter products, and related services. Products made from non halal ingredients must have clear non halal labels on the packaging, which can be symbols, logos, or written notices.

Import product certification

Imported products sold in Indonesia must obtain halal certification. Only Halal certificates issued by international organizations that have signed mutual recognition agreements with the Indonesian Ministry of Health (BPJPH) will be accepted. In this case, the product only needs to be registered with the Indonesian Ministry of Health (BPJPH) and does not require re certification in Indonesia.

Unrecognized foreign halal institutions

If BPJPH does not recognize foreign halal institutions, products must go through the Indonesian halal certification process, even if certified abroad.

Non-compliance Penalties

Failure to comply with halal certification requirements may result in administrative penalties, including:

  1. Written warning.
  2. Fines.
  3. Product recall.

What new obligations do Indonesian Halal certification rules impose on companies?

Government Order No. 42/2024 imposes further responsibilities on enterprises that have obtained halal certification, based on the requirements outlined in Government Order No. 39/2021. These new responsibilities include:

  1. Display halal labels on products that have obtained halal certification.
  2. Ensure that products certified as halal comply with halal standards.
  3. Different areas, facilities, and tools should be set up for halal and non halal products during the slaughter, processing, storage, packaging, distribution, sales, and display processes.
  4. If there are changes in the composition of ingredients or the Halal Process (PPH) of the product, please update the Halal Certificate.
  5. If there are any changes in the composition of ingredients or PPH, please inform the Department for Halal Food and Public Service (BPJPH) in the UK.

Enterprises also need to maintain the halal integrity of their products by obtaining a certificate of halal conformity. This certificate needs to be issued after evaluating its Halal Product Assurance System (SJPH). This assessment must be conducted every four years. The review will be based on a risk assessment of micro and small businesses.

Failure to comply with these additional responsibilities and other provisions of Government Order No. 42/2024 may result in administrative penalties such as written warnings, fines, revocation of halal certificates, or withdrawal of distributed products.
